A year ago I was hurt in an accident, but I now need surgery and the insurance company has closed their file. Can I sue?

Yes. An insurance company closing their file doesn’t mean anything. An insurance company will oftentimes tell folks that they have closed their file, but it doesn’t have any legal significance. In Florida an individual has up to 4 years to sue the at-fault driver. Someone who finds out that they need surgery a year after the auto accident date, it can still sue because they’re within that 4-year statute of limitations.
