Deadly Motorcycle Collision in Martin County

Motorcycle5

A woman is dead following a harrowing wrong-way crash that also seriously injured several other motorists.

The wreck, which occurred near the intersection of Citrus Road and Boatramp Avenue, involved two motorcycles, a Nissan Maxima, and a Ford Ranger. Two westbound motorcyclists passed a vehicle in a no-passing zone. An eastbound Maxima hit the motorcycles almost head-on. One rider was killed and another one was seriously injured.

The Maxima driver was also seriously injured. The Ranger was able to avoid the wreck, but overturned on the side median.

Motorcycle Crash Injuries

Vehicle collision victims have multiple restraint layers and steel cages to protect them. But for the most part, motorcycle riders are completely exposed to danger. So, motorcycle riders are almost thirty times more likely to die in these collisions. Some of the serious injuries these individuals sustain include:

  • Exsanguination: Blood loss is often the official cause of death in fatal motorcycle crash cases. Because of internal and external injuries, many victims have lost so much blood they are in hypovolemic shock when emergency responders arrive. These patients are difficult to stabilize.
  • Head Injuries: These same forces cause a number of head trauma injuries. Many times, the motion alone causes such wounds. Sudden, violent motion scrambles the brain, just like shaking an egg scrambles the yolk.
  • Biker’s Arm: These injuries may not be life-threatening, but they are usually permanent. When riders fall from their bikes, they naturally extend their arms to break their falls. As a result, they destroy nerve tissue in the brachial plexus area.

Due to the serious nature of these injuries, compensation is often rather substantial. This compensation usually includes money for economic losses, such as medical bills, and noneconomic losses, such as pain and suffering.

Your Claim for Damages

Most vehicle collision claims, especially wrong-way crashes, are quite complex. Even if an emergency responder said you were at fault, you may have legal options.

It is illegal to drive on the wrong side of the road. But in Florida, this conduct only creates a presumption of negligence. There is a significant difference between a presumption and a conclusion.

Furthermore, the official record, which is normally the police accident report, may be inaccurate. If the victim was killed or seriously injured, as was the case in the above wreck, the police report obviously contains only one side of the story.

So, tho build a claim for damages, a Port St. Lucie personal injury attorney often needs to uncover additional evidence and turn to some specific legal theories.

This additional evidence often includes a vehicle’s Event Data Recorder. These gadgets, which are like commercial airline black boxes, measure and record things like vehicle speed and steering angle. This additional evidence gives the jury a better idea of what happened.

Legally, the last clear chance doctrine often comes up in wrong-way collision claims. In the above story, if the Maxima driver had a reasonable chance to avoid the crash, perhaps by swerving onto the shoulder, the Maxima driver is legally responsible for the wreck.

The last clear chance doctrine may also be a factor in other cases, such as rear-end and intersection collision claims.
