Deadly Vehicle-Moped Accident in Fort Pierce

Police are still investigating a rear-end crash that killed a moped rider. However, they have few clues as to what happened.

The wreck occurred on southbound U.S. Highway 1 near the Tumblin Road intersection. A car rear-ended a moped, and the moped rider died at the scene.

Motorcycle Injuries

Sophisticated airbags and other advances have made passenger cars much safer than they were in the twentieth century. But motorcyclists do not benefit from any of these innovations. Instead, they are almost completely exposed to danger in a crash. As a result, a motorcycle rider is about twenty-eight times more likely to die in a crash than a vehicle occupant. Some of these serious injuries include:

  • Biker’s Arm: When people fall off their bikes, they naturally extend their arms to break their falls. Because of the tremendous force in a motorcycle crash, that reaction often snaps nerves in the brachial plexus area under the arms. The resulting paralysis is usually permanent.
  • Exsanguination: Excessive blood loss, mostly due to internal bleeding, is often the official cause of death in motorcycle crashes. The same forces that cause nerve damage also cause internal organs to bump and grind against each other. As a result, they often bleed profusely.
  • Head Injuries: Following a familiar theme, motion usually causes head injuries. The sudden force causes the brain to slam against the inside of the skull. No motorcycle helmet on earth can protect against these kinds of injuries.

The medical bills in motorcycle crash claims often exceed $100,000. Most health insurance companies refuse to pay these costs, and most families do not have the money to pay them.

A Port St. Lucie personal injury attorney usually arranges for complete medical care, from the first day of hospitalization to the last day of physical therapy. Generally, providers charge nothing upfront for their services. Instead, they agree to defer billing until the case is resolved.

What to Expect in a Motorcycle Crash Claim

Liability is usually relatively clear in rear-end crash claims, unless the last clear chance doctrine is in play. Unfortunately, that does not mean the case will settle quickly.

Generally, liability is unclear enough for insurance companies to avoid prompt settlement. Their lawyers often cite defenses, like the last clear chance rule, which probably will not hold up in court. So, to put pressure on the insurance company, most attorneys file legal claims.

Typically, insurance company lawyers file procedural motions seeking to throw the victim/plaintiff’s claim out of court. Assuming the victim/plaintiff’s lawyer diligently collected evidence prior to filing suit, these motions almost always fail.

The discovery period comes next. The parties exchange information about their claims and defenses. Many cases settle once both parties put all their cards on the table.

If the case remains unresolved, most St. Lucie County judges refer the matter to mediation. A third party mediator works with both sides, trying to facilitate a settlement. If both parties negotiate in good faith, mediation is often successful.
