Florida Truck Accidents

A driver of a motor vehicle faces many dangers any time they get behind the wheel of a car. There are many different dynamics at play when a driver sets out on a journey for their next destination. Inexperienced drivers, distracted drivers, and reckless drivers alike make driving one of the most dangerous activities completed each day. In addition, commercial motor vehicle or truck drivers present unique hazards causing thousands of accidents each year. These drivers engage in many of the same negligent and reckless driving hazards that thousands of Americans complete each day. However, it is even more dangerous as commercial motor vehicles carry tens of thousands of pounds of weight.

Have you Been Injured Due to a Driver’s Negligent or Reckless Behavior?

If you have been injured as a result of a collision with a truck or commercial motor vehicle, you need to speak with an experienced attorney in your area. Extensive investigation is necessary to properly build a case against the driver, the company that employs the driver, and/or an insurance company. Unfortunately, defendants in commercial motor vehicles accidents are much less likely to admit fault or offer proper compensation, given the amount of liability resulting from these serious occurrences. Our firm focuses on client satisfaction and obtaining a just monetary result in all of our cases. Whether your goal is settlement of litigation, we have the knowledge necessary to obtain a fair result. If a fair amount of compensation cannot be obtained through settlement our attorneys are willing to take your personal injury claim to trial. We serve clients in and around Port St. Lucie, Florida. Contact us today for an initial consultation, so that you can be on your way to recovery.

Common Causes of Truck Accidents

According to a report issued by the National Highway Traffic Safety Administration, there were 3,964 fatal truck accidents in 2013. In addition, there were 95,000 people injured in accidents involving trucks. Florida was amongst the highest in fatal truck accidents, which accounted for 187 tragic accidents, accounting for nearly 5 percent of truck accidents.

Some common causes of these accidents are due to:

  • Inexperience;
  • The Federal Motor Carrier Safety Administration regulates the amount of time truckers may drive. These hours are as follows: (1) 11 hours in a 14 hour work day; (2) 8 hours without a rest break; (3) 60 hours in a 7 day work week; and (4) 70 hours in a 8 day work week. Unfortunately, many truckers drive beyond what the law allows leading to distractions and fatigue;
  • Adverse weather conditions;
  • Failure to obey traffic signals;
  • Tailgating;
  • Driving under the influence of drugs or alcohol: driving under the influence of alcohol presents a risk to everyone on the road. The legal limit is .04 for all commercial truck drivers. It is less than the limit for other motorists, as there is a greater level of danger when driving tractor trailers and other large commercial drivers;
  • Cell phone use;
  • Equipment failure; and
  • Speeding.
