We live in a world where conflicts can quickly turn into physical fights. Sometimes, there is no conflict at all and a victim still falls prey to a mugger or another type of violent individual lurking in the dark. This is why we have law enforcement, security guards, security cameras, and other measures like fences and floodlighting in public places. When an individual is lawfully in a public place, he or she should feel safe there. And when he or she suffers an injury because of insufficient security, he or she has the right to pursue compensation for all related damages through a personal injury claim, contact our lawyers today.

Examples of Negligent Security

Different types of buildings need different levels of security support. For example, an apartment building might have security cameras around the property or an electronic gate that can only be opened with the correct code. A shopping mall typically has security guards, and many bars and clubs have bouncers whose job is to prevent fights and attacks.

Not all conflict-related injuries can be attributed to negligent security, but when your injury could have been prevented if a property owner had taken greater care to secure the premises, you could have grounds for a negligent security claim. Examples of negligent security include:

  • A lack of security guards in a place where there is a reasonable expectation for security guards;
  • Insufficient lighting indoors or outdoors;
  • Bouncers or security guards failing to take proper measures to keep rowdy or threatening individuals under control; and
  • Broken or insufficient security cameras.

Pursuing Compensation for the Damages you Suffer Due to Negligent Security

 When you are injured in an attack, you can file a criminal charge against the individual who hurt you. You can also file a negligent security claim with the property owner whose negligence made your attack and resulting injury possible. These are two separate cases; your attacker does not need to be convicted of a crime for you to recover compensation for your personal injury damages.

To recover compensation for your personal injury damages, which can include your medical bills, your short- and long-term lost wages, and any pain and suffering damages you experienced, you must demonstrate how the property owner was negligent in the area of security. This can mean showing that his or her property was not well lit or that there were not sufficient security guards on the property to protect its patrons and guests. Evidence you can use to demonstrate these points include:

  • Photographs of the environment where you were attacked;
  • A copy of your official accident report;
  • Documentation showing a lack of security cameras or personnel at the property; and
  • Testimonies from eyewitnesses of the attack and others who are familiar with the lack of security at the property.
