What is the difference between no fault and at fault?

No-fault is Florida’s version of personal injury protection. What that simply means is that the first ten thousand dollars of any accident is paid by one’s own insurance company, no matter who’s at fault for the accident. The first ten thousand dollars of injuries or medical bills is paid by everyone’s own insurance company. At-fault means that after that first ten thousand dollars is paid, the at-fault driver’s insurance company is responsible for any additional medical expenses that an individual may have, as a result of the fault of the defendant.
