Actions to Take When You Get Arrested

A lot can go wrong during an arrest and in the immediate hours afterwards. From false confessions to unintentionally revealing information that makes them appear to be guilty of a crime, defendants are often tricked by the police when they get arrested and before their lawyer shows up. While our criminal justice system is better than that of many nations, it is still not without fault. After all, a study by the Office of Justice Programs found that 11.6 percent of cases with a sexual assault component led to wrongful convictions. And, 30 percent of DNA exonerations involve cases with false confessions, according to the Huffington Post and the Innocence Project. To protect yourself when you are arrested, we strongly recommend using your constitutional right to remain silent and protect yourself from self-incrimination. Remember the following:

  • Police questioning is done to build evidence of your guilt, not to clear your name;
  • Contradictory statements can be used to make you look dishonest. A lengthy interrogation, during which food and sleep are withheld, causes confusion and innocent but false statements to be made; and
  • Law enforcement officers are experienced in leading you to make contradictory statements.
