Yes. In Florida we have a concept known as comparative negligence. That’s where both parties may have some fault in the accident and therefore what happens is the injuries or the percentage of fault is comparable between both parties. It could be 75% for the one side and 25% for the other or some other variation, but yes, both parties can be found at fault.
