This is the first time I am in trouble in Florida. Will the prosecutor treat this charge like it is my first offense?

Assuming this is your only charge in the whole country, you will be subject to certain diversionary programs or first offender programs. Just because it’s your first offense in Florida doesn’t mean that the prosecutors don’t have access to what’s called your NCIC. It’s the National Criminal Data Base. They can see criminal histories in all states regardless of just Florida.
