What evidence of injury is necessary to recover damages in a Florida auto accident case?
Transcript
Evidence of injury is dependent on what we call a threshold evidence or threshold injury. Meaning there has to be some permanent injury in Florida that we must establish in order to have a damage case. That usually depends on if there is a broken bone, for example, that we can show on an x-ray, or is there a herniated disk that we can show on an MRI, or is there some other test, medical test, that can show a damage in some way. Damages are so vastly different in every accident, there’s no possible way that we can possibly list every damage known, but there are medical tests that will show damages, and as long as we can show a permanent damage, that meets that threshold test, then we have a case in Florida.
