The resolution of any auto case depends on sever factors. The first factor is, when does the individual get released from active medical treatment? Of course that’s up to the doctor whose treating the client. Once that person has been released from active medical treatment, then the attorney can then present the case to the insurance company, and try to negotiate a settlement. Most cases are settled in this manner. However for those that aren’t, a lawsuit must be filed, and then a settlement can occur after a lawsuit is filed. For those cases that aren’t settled at that phase, then a jury trial has to ensue. Sometimes that can take years, but for most cases it’s usually months after the individual has been released from medical treatment.
