If the case is settled at mediation, then one of the parties has to have a short court hearing in front of the judge in order to obtain the actual divorce. It depends on the complexity of the case, it depends on what is agreed. If everything is agreed at mediation, then often times, no, the individual does not have to go to court. If, however, things are not agreed at mediation, and the case has to be tried, then yes, the parties do have to go to court.
