Sometimes yes and sometimes no. It depends on the health insurance policy itself. An attorney has to look at the policy and read the policy to see if there’s something called subrogation rights, or the right to be repaid if the insurance company paid for any injuries or medical bills that were as a result of the auto accident itself. If the policy has language that they have the right to be repaid, then they can be repaid. However, the attorney also can negotiate those repayments and try to negotiate them down so that you don’t have to pay them back dollar for dollar.
